1. Status and operator
These are draft terms for the PokePrice EU private pilot. The operator’s approved legal name, postal address, governing law, and venue must be inserted before these terms support a paid public offer. Nothing here removes rights that cannot lawfully be excluded under the consumer law that applies to you.
2. Pilot access
Access is invitation-only, personal, limited, non-exclusive, non-transferable, and intended for evaluation of the current Windows app and focused mobile companion. The pilot can change, pause, or end as the product is tested. A public subscription or continuing feature set is not promised.
You must be at least 18, or use the service with a parent or guardian who can accept the applicable terms for you.
3. Accounts and devices
Keep account credentials and license keys confidential, provide accurate account information, and tell us promptly if you suspect unauthorized use. Device binding and reset limits protect pilot licenses from abuse. You remain responsible for actions taken through your account unless applicable law provides otherwise.
4. Permitted use
You may use the service for your own lawful collection research. You must not:
- resell, share, sublicense, or bypass an account or device limit;
- probe, disrupt, overload, or defeat service or security controls;
- extract or republish market or catalog data in bulk;
- reverse engineer except where that restriction is prohibited by law;
- use the service to infringe rights, mislead others, or automate purchases;
- upload malicious code or credentials that you are not authorized to use.
5. Your collection data
You retain rights in collection notes and other original content you provide. You give the operator the limited permission needed to host, sync, back up, calculate, and display that content for the service. You are responsible for ensuring that content is lawful and that you have permission to provide it.
6. Product and third-party data
The app combines product records, current offers, historical observations, exchange rates, and other third-party market information. Sources can be delayed, incomplete, removed, or wrong. Trademarks and third-party content remain with their owners. The service does not give you a right to republish source data.
7. Estimates are not advice
Prices, portfolio values, trends, forecasts, confidence ranges, alerts, and grading or condition references are estimates for research. They are not a guarantee of a sale price, liquidity, authenticity, condition, return, or future performance, and are not investment, tax, legal, or professional advice. Check source listings and exercise your own judgment before acting.
8. Availability and changes
Pilot software may contain defects and can require updates. Features, refresh cadence, data coverage, and supported platforms may change. We will use reasonable care in operating the pilot but do not promise uninterrupted or error-free availability.
9. Suspension and ending access
Access may be suspended for a security incident, abuse, material breach, legal requirement, or risk to other users or the service. Where reasonable, we will explain the reason and provide a way to contact support. You may stop using the pilot at any time. To request account deletion, email pilot@kihakookt.com.
10. Fees and future purchases
The current private pilot is free and has no public checkout, so this website does not accept purchases or payments. If a paid offer is introduced in the future, its checkout will show the price, billing period, renewal terms, and any required cancellation, withdrawal, and refund information before purchase.
11. Liability
To the maximum extent permitted by applicable law, the pilot is provided as available and the operator is not responsible for an indirect loss, missed transaction, market movement, or decision made from an estimate. This does not limit liability for fraud, willful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or anything else that cannot legally be limited.
12. Privacy, changes, and contact
Personal data is handled as described in the privacy notice. Material term changes will be dated and communicated where appropriate; changes do not remove accrued mandatory rights. Questions can be sent to pilot@kihakookt.com.
